These Terms and Conditions (“Terms”) govern your access to and use of the Zone Rush website at zone-rush.com and the playable web game (including via play.zone-rush.com) and any related services, content, virtual items, customer support channels, and community features (together, the “Service”).

By accessing or using the Service, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, do not use the Service.

References to “we”, “us”, or “our” mean INDIGO INTELLECT LTD.

2. Definitions

• Account: a profile created or used to access the Service (including any third-party login, if enabled).
• Content: all text, graphics, images, audio, video, software, code, and other materials on the Service.
• Virtual Currency / Virtual Items: in-game currency, items, cosmetics, boosters, or other digital goods used within the game.
• Purchase: a transaction to obtain Virtual Currency, Virtual Items, or other paid digital content.
• User Content: any content you submit, upload, post, transmit, or otherwise make available through the Service.

3. Eligibility and Age Requirements

1. Minimum age. You must be at least 13 years old (or the minimum age required in your country) to use the Service.
2. Purchases by minors. If you are under 18, you may make Purchases only with the consent and supervision of a parent/legal guardian who is authorised to use the payment method.
3. Parental responsibility. Parents/guardians are responsible for monitoring and supervising a minor’s use of the Service, including Purchases and gameplay.

We do not knowingly collect personal data from children under 13. If you believe a child under 13 has provided personal data, contact us immediately at info@zone-rush.com.

4. Changes to the Service and Terms

1. We may modify, update, suspend, or discontinue any part of the Service at any time, including game mechanics, Virtual Items, pricing, features, and availability.
2. We may update these Terms from time to time. The “Last updated” date will change. Your continued use after changes become effective constitutes acceptance of the updated Terms.

5. Your Account and Security

1. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your Account.
2. You must provide accurate information where the Service requires it and keep it up to date.
3. You must notify us immediately of any unauthorised use or suspected breach of security.

We may suspend or terminate Accounts where we reasonably suspect fraud, security compromise, or violation of these Terms.

6. Licence and Permitted Use

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable licence to access and use the Service for your personal, non-commercial entertainment purposes.

You must not:

• reproduce, distribute, publicly display, sell, rent, lease, sublicense, or commercially exploit the Service or Content;
• reverse engineer, decompile, disassemble, or attempt to derive source code, algorithms, or underlying ideas of the Service except to the extent permitted by law;
• bypass or attempt to bypass security, rate limits, anti-cheat, access controls, or payment protections;
• use bots, macros, automation tools, cheats, exploits, or any unauthorised third-party software to access or manipulate the Service.

7. Intellectual Property

The Service and all Content are owned by or licensed to us and are protected by intellectual property laws. All rights not expressly granted are reserved.

“Zone Rush” and related logos/branding may be trademarks of INDIGO INTELLECT LTD or its licensors. You may not use them without prior written consent.

8. Virtual Currency and Virtual Items

1. No ownership / no cash value. Virtual Currency and Virtual Items are licensed to you, not sold. They have no real-world monetary value, are not legal tender, and cannot be redeemed, exchanged, or converted into cash or any other goods/services outside the Service, unless we explicitly state otherwise in writing.
2. No transfer unless permitted. Unless the Service explicitly allows it, you may not transfer, sell, gift, trade, or barter Virtual Currency/Items to any person or third party.
3. Changes and rebalancing. We may modify, rebalance, remove, rename, or reconfigure Virtual Currency/Items, including their “value”, utility, or availability, without liability to you.
4. Forfeiture. We may revoke Virtual Currency/Items if we reasonably suspect fraud, chargeback abuse, policy violations, or technical errors (including accidental credits).

9. Purchases, Pricing, and Payments

1. Checkout and payment processors. Purchases may be processed by third-party payment providers. Your transaction may be subject to their terms and privacy notices in addition to ours.
2. Pricing and currencies. Prices, available products, and available currencies may vary by region and are shown at checkout. Supported currencies may include USD, EUR, AUD, GBP, CAD (availability may change).
3. Taxes. Where applicable, taxes may be added at checkout and displayed before you confirm the Purchase.
4. Delivery. Virtual Currency/Items are normally delivered digitally and/or made available in-game shortly after successful payment.
5. Errors. If you believe you were charged incorrectly or did not receive purchased content, contact support at info@zone-rush.com with transaction details.

10. Refunds and Chargebacks

1. Refund policy. Refund requests are handled under our Payment and Refund Policy (available on the website).
2. Digital content acknowledgement. By making a Purchase, you acknowledge that the content is digital and may be made available immediately after payment confirmation. Where applicable law allows, this may affect your ability to withdraw/cancel.
3. Chargeback abuse. Initiating unjustified chargebacks, payment reversals, or disputes after receiving digital content may result in suspension/termination of your Account and revocation of related Virtual Currency/Items, to the extent permitted by law.

Nothing in these Terms limits statutory consumer rights that cannot be excluded.

11. User Content and Community Features

If the Service allows you to submit User Content (e.g., chat, feedback, support submissions, comments, screenshots):

1. Your responsibility. You are solely responsible for your User Content and ensuring you have all rights required to submit it.
2. Licence to us. You grant us a worldwide, royalty-free, sublicensable, transferable licence to host, store, reproduce, adapt, publish, translate, distribute, and display your User Content for the purpose of operating, improving, marketing, and providing the Service.
3. Moderation. We may remove or restrict User Content at our discretion (without notice) if we believe it violates these Terms or applicable law.

12. Acceptable Use (Prohibited Conduct)

You must not:

• violate any law, regulation, or third-party rights;
• harass, threaten, defame, or abuse others;
• post illegal, hateful, discriminatory, sexually explicit, or exploitative content;
• attempt to gain unauthorised access to systems, accounts, or data;
• introduce malware, spyware, or harmful code;
• exploit bugs or vulnerabilities; you must report them to info@zone-rush.com;
• engage in fraud, payment abuse, refund abuse, or chargeback abuse.

13. Third-Party Links, Services, and Advertising

The Service may contain third-party links, integrations, ads, analytics, or embedded services. We do not control third parties and are not responsible for their content, policies, or practices. Your interactions with third parties are at your own risk and subject to third-party terms.

14. Availability, Updates, and Maintenance

The Service is provided on an “as available” basis. We do not guarantee uninterrupted access. We may perform maintenance, deploy patches, or change infrastructure that may affect availability and performance.

15. Disclaimers

To the maximum extent permitted by law:

1. The Service is provided “as is” and “as available”, without warranties of any kind (express or implied), including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
2. We do not warrant that the Service will be error-free, secure, or free from harmful components.
3. We do not warrant that any Virtual Item will remain available or retain any particular functionality.

Some jurisdictions do not allow certain warranty disclaimers; in that case, disclaimers apply to the maximum extent permitted.

16. Limitation of Liability

To the maximum extent permitted by law:

1. We will not be liable for indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, goodwill, data, or business interruption arising from or related to your use of the Service.
2. Our total liability for all claims arising out of or relating to the Service shall not exceed the greater of:
   • the amount you paid to us for Purchases in the three (3) months preceding the event giving rise to the claim; or
   • GBP 50.
3. Nothing in these Terms excludes or limits liability for: death or personal injury caused by negligence, fraud, fraudulent misrepresentation, or any liability that cannot be excluded by law.

17. Indemnity

You agree to indemnify and hold harmless INDIGO INTELLECT LTD and its directors, officers, employees, and contractors from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to your breach of these Terms, your misuse of the Service, or your violation of any law or third-party rights.

18. Suspension and Termination

1. We may suspend or terminate your access to the Service immediately if we reasonably believe you have breached these Terms, engaged in fraud/abuse, or pose a security or legal risk.
2. Upon termination, your licence ends and you must stop using the Service.
3. Virtual Currency/Items associated with Accounts terminated for breach or abuse may be forfeited to the extent permitted by law.

19. Privacy and Cookies

Your use of the Service is also governed by our Privacy Policy and Cookie Policy, available on the website. These explain how we collect, use, share, and protect personal data and how cookies/analytics operate.

20. Governing Law and Jurisdiction

These Terms and any dispute or claim arising out of or in connection with them (including non-contractual disputes) are governed by the laws of England and Wales.

Courts of England and Wales shall have exclusive jurisdiction, except where mandatory consumer protection rules grant you the right to bring claims in your country of residence.

21. Miscellaneous

1. Severability. If any provision is found unlawful or unenforceable, the remainder remains in effect.
2. No waiver. Failure to enforce any right is not a waiver.
3. Assignment. We may assign or transfer these Terms as part of a merger, acquisition, restructuring, or asset sale. You may not assign your rights without our written consent.
4. Entire agreement. These Terms, together with referenced policies, constitute the entire agreement between you and us regarding the Service.
